The Copyright Office handed Pandora a procedural victory late Friday in the Internet service's quest to have the Copyright Royalty Board (CRB) consider its past deals with independent music label rights consortium Merlin and independent label Naxos as possible benchmarks for CRB’s 2016-2020 webcasting rate-setting proceeding. The 2009 Webcaster Settlement Act (WSA) doesn’t prohibit the admissibility of direct licenses like Pandora’s Merlin/Naxos deals that are clearly influenced by WSA terms, Register of Copyrights Maria Pallante said in the ruling. Copyright royalty judges are normally barred from considering alternative rate structures authorized by WSA in rate-setting proceedings since they aren’t set by CRJs, but direct licenses don’t fall under that prohibition, Pallante said.
The Commerce Department will require antidumping duty cash deposits on imports of silicomanganese from Australia, it said in a Sept. 18 fact sheet (here). The agency set AD duty cash deposit rates at 11.93% for the sole Australian exporter under investigation, TEMCO. The new cash deposit requirements will take effect on the date Commerce publishes its preliminary determination in the Federal Register.

The Commerce Department issued the final results of the antidumping duty administrative review on utility scale wind towers from Vietnam (A-552-814) (here). Commerce determined the only companies under review, CS Wind Vietnam and its affiliate CS Wind Corporation, did not undersell subject merchandise during the period of review, assigning them a zero percent AD duty rate. Subject merchandise from CS Wind entered between Feb. 13, 2013 and Jan. 31, 2014 will be liquidated without any assessment of AD duties, and future entries of subject merchandise exported by CS Wind will not be subject to AD duty cash deposit requirements until further notice. These final results take effect Sept. 15.

These final results will be used to set final assessments of AD duties on importers for entries from Feb. 1, 2013 through Jan. 31, 2014. The Commerce Department issued the final results of its countervailing duty administrative review on large residential washers from South Korea (C-580-869) (here). These final results will be used to set final assessments of CV duties on importers for subject merchandise entered June 2012 through December 2013 from the two companies under review, Samsung and Daewoo. For entries on or after Sept. 15, Commerce is also setting new CV duty cash deposit rates for Daewoo and Samsung. The new rates are as follows:
The Commerce Department issued the final results of its antidumping duty administrative review on large residential washers from Mexico (A-201-842) (here). For entries on or after Sept. 15, Commerce is setting a 6.45% AD duty cash deposit rate for Electrolux Home Products Corp. NV/ Electrolux Home Products de Mexico, S.A. de C.V. The agency also found Samsung Electronics Co., Ltd. did not have any shipments of subject merchandise during the period under review, so Samsung's cash deposit rate will remain unchanged. Commerce will calculate importer-specific assessment rates for all entries of subject merchandise from Electrolux with a time of entry between Aug. 3, 2012 through Jan. 31, 2014.

Commerce assigned the only company under review, Bhansali Bright Bars Pvt. Ltd., a zero percent AD duty rate. Subject merchandise from Ambica entered between Feb. 1, 2013 and Jan. 31, 2014 will be liquidated without any assessment of AD duties, and future entries of stainless steel bar exported by Ambica will not be subject to AD duty cash deposit requirements until further notice. The new AD duty cash deposit rate takes effect Sept. 15.
