The Commerce Department issued the preliminary results of its antidumping duty administrative review on steel wire garment hangers from China (A-570-918) (here). Once Commerce issues its final results, the agency will use the AD rates calculated in this review to set new cash deposit rates for some companies and assessments of AD duties on importers for entries between October 2012 and September 2013.

The Commerce Department is extending until Jan. 23 the deadline for its preliminary determination in the countervailing duty investigation on boltless steel shelving units prepackaged for sale from China (C-570-019) (here). The agency decided to postpone after finding the investigation is “extraordinarily complicated” because of the number and complexity of the subsidy programs being investigated. The preliminary determination was originally due Nov. 19. Cash deposits of estimated CV duties can only be collected after the preliminary determination, although cash deposits can be made retroactive 90 days from the preliminary determination if Commerce finds “critical circumstances.”
The Commerce Department issued the final results of the antidumping duty administrative review on citric acid and certain citrate salts from China (A-570-937) (here). These final results will be used to set assessments of AD duties on importers for entries between May 1, 2012 and April 30, 2013.
The Commerce Department made a preliminary affirmative antidumping determination that sugar from Mexico (A-201-845) is being sold in the U.S. at less than fair value (here). Despite having reached a preliminary deal to suspend the investigations (see 1410280027), Commerce is directing CBP to suspend liquidation and require cash deposits of estimated AD duties, effective for subject merchandise entered on or after Nov. 3. If the suspension agreement is finalized, cash deposits will be refunded.
Countervailing duty cash deposit requirements will take effect Nov. 3 for some imports of steel nails from Vietnam (C-552-819), after the Commerce Department found illegal subsidization of some Vietnamese producers in its preliminary determination (here). The agency calculated CV duty rates ranging from zero to 8.35 percent.

U.S. District Court Judge Alison Nathan’s ruling slapping a nationwide preliminary injunction on Aereo (see 1410230060) could lead to more litigation for the streaming service, said Fletcher Heald First Amendment attorney Kevin Goldberg in a blog post Wednesday. Aereo could appeal the portion of the injunction limiting it to broadcasting time-delayed content, or broadcasters could appeal that the injunction allows Aereo to provide some form of streaming service. “A time-delayed Aereo is still a competitor in many ways,” said Goldberg. Either side of the case could also choose to let the matter be decided on the merits. “This obviously suits the broadcasters to some extent, since Aereo may not be as attractive to potential subscribers without the live viewing function,” Goldberg said. NAB and Aereo did not comment.
