The Commerce Department issued a Federal Register notice on its recently initiated antidumping duty investigation on truck and bus tires from Thailand (A-549-848). The agency will determine whether imports of Thai truck and bus tires are being sold in the U.S. at less than fair value. The investigation covers entries from Thailand during the period Oct. 1, 2022, through Sept. 30, 2023.
Robert F. Kennedy Jr. is appealing the denial of his motion for preliminary injunction heard Tuesday in a First Amendment lawsuit vs. Google, said his notice of appeal (docket 3:23-cv-03880) Wednesday in the 9th Circuit U.S. Court of Appeals. U.S. District Judge for Northern California Trina Thompson found that Kennedy, a 2024 independent presidential candidate, “does not allege any deprivation of rights caused by state action, and the First Amendment claim fails as to Google as Google has not been established as a state actor,” said her text-only entry Tuesday. Kennedy sued Google in July (see 2308030049), alleging it censored his viewpoints on vaccines and other subjects under pressure from the Biden administration. He sought a preliminary injunction enjoining Google from removing his anti-vaccine videos on YouTube that violated its medical misinformation policy. In September, the 9th Circuit said it lacked jurisdiction over Kennedy’s emergency motion for injunction pending appeal following the district court’s denial of his application for a temporary restraining order vs. Google (see 2309210031).
The Commerce Department is setting new antidumping duties on imports of Chinese small and large garlic chunks, after preliminarily finding the imports are circumventing antidumping duties on fresh garlic from China (A-570-831).
U.S. Magistrate Judge Mario Garcia for Southern Indiana in Indianapolis set a Nov. 21 status conference at 3:30 p.m. EST in the lawsuit brought by seven plaintiffs against Indiana Attorney General Todd Rokita (R), said Garcia’s signed scheduling order Wednesday (docket 1:23-cv-01805). The purpose of the conference is to discuss the plaintiffs' Nov. 3 motion for a preliminary injunction to block Rokita from enforcing HB-1186, the state law that took effect July 1 making it a misdemeanor for journalists to come within 25 feet of police officers on official duty (see 2311060046). The plaintiffs are the Indiana Broadcasters Association, the Indiana Professional Chapter of the Society of Professional Journalists, the Indianapolis Star, Nexstar, the Reporters Committee for Freedom of the Press, Scripps and Tegna. They allege that HB-1186 violates the First and 14th Amendments “on its face,” and as applied to the plaintiffs’ “peaceful, nonobstructive newsgathering in public places.”

Granting the space exploration company's motion for a preliminary injunction in part and denying it in part, Judge Rolando Olvera said SpaceX is likely to succeed on its claim that a law making it illegal to discriminate based on citizenship status in hiring decisions, 8 U.S.C. 1324b, violates the Appointments Clause under the U.S. Constitution (Space Exploration Technologies v. Carol Bell, S.D. Tex. # 23-00137).
