The Commerce Department issued the final results of its countervailing duty administrative review on citric acid and citrate salts from China (C-570-938). The agency increased RZBC's CV duty rate from its preliminary finding in June. These rates are effective Jan. 2, and will be implemented by CBP soon.
The Commerce Department issued the final results of the antidumping duty administrative review on citric acid and citrate salts from China (A-570-937). The agency continued to find a zero AD rate for RZBC Imp. & Exp. Co., Ltd., and found the other respondent, Yixing Union Biochemical Ltd., had no shipments to the U.S. during the period of review. Commerce will direct CBP to liquidate period of review entries of subject merchandise from RZBC I&E without regard to AD duties, and will not collect a cash deposit on future entries of subject merchandise exported by RZBC I&E until further notice. Subject merchandise from Yixing Union will continue to enter at AD cash deposit rates set in previous reviews. The new rate is effective Jan. 2, and will be implemented by CBP soon.
The Commerce Department issued the final results of its countervailing duty administrative review on aluminum extrusions from China (C-570-968). Because the review spanned part of calendar year 2010 and all of calendar year 2011, the agency calculated CV duty rates for each year for reviewed companies. The CV duty cash deposit rate in effect going forward for each company will be the 2011 rate. These rates are effective Jan. 2, and will be implemented by CBP soon.

As such, Commerce will direct CBP to liquidate period of review entries of subject merchandise from Kromet without regard to AD duties, and will not collect a cash deposit on future entries of subject merchandise exported by Kromet until further notice. Commerce found the other mandatory respondent, Zhongya/ Guang Ya/Xinya, didn't demonstrate independence from state control and assigned it to the China-wide entity along with 24 other companies. The new rates are effective Jan. 2, and will be implemented by CBP soon.
Streaming TV service Aereo shouldn’t be allowed to file an amicus brief in its competitor FilmOn’s appeal of the nationwide preliminary injunction imposed by the D.C. district court, said broadcasters in a filing with the U.S. Court of Appeals for the D.C. Circuit Thursday. Aereo had filed a motion for leave to file a brief in support of neither party, but Aereo’s proposed brief is just a duplicate of FilmOn’s arguments, broadcasters said. “Aereo is itself a defendant in copyright cases involving the same plaintiffs and issues” said the broadcasters. “Its proposed brief is simply an effort to circumvent Appellants’ page limits.” Aereo “has a direct interest in the legal principles to be determined by this Court in these appeals,” argued Aereo in its motion. The D.C. circuit has a rule against briefs repeating the same facts and arguments, the broadcasters said. It’s not surprising that Aereo’s interests “are indistinguishable from Appellants’ interests,” said the broadcasters. FilmOn will make all the same arguments in its appeal, the broadcasters said, “obviating any need for a duplicative recitation of these same arguments by the identically-situated Aereo."
The FCC’s 2015 World Radiocommunication Conference Advisory Committee will meet Jan. 27, the FCC said Monday in the Federal Register. The committee is collaborating with NTIA’s Interdepartment Radio Advisory Committee Radio Conference Subcommittee on consensus opinions on multiple WRC agenda items, which it will eventually present to the State Department (CD Dec 23 p9). The WRC Advisory Committee’s Jan. 27 meeting will include a presentation of the committee working groups’ preliminary views and draft proposals, the FCC said. The meeting is set to begin at 11 a.m. in the Commission Meeting Room. The meeting will also be webcast on the FCC’s website (http://1.usa.gov/1fW5DG2).

The Commerce Department preliminarily found Hitachi Metals to be the successor of Hitachi Cable for antidumping duty purposes, in the preliminary results of a changed circumstances review of stainless steel sheet and strip in coils from Japan (A-588-845). The two companies recently merged and Hitachi Cable became defunct, but the former company’s production operations are nearly unchanged under Hitachi Metals. If Commerce finalizes its determination, Hitachi Metals will become subject to Hitachi Cable’s zero AD duty rate, effective for entries made on or after the date of Commerce’s final results.
The Commerce Department issued the final results of the antidumping duty administrative review on circular welded non-alloy steel pipe from Mexico (A-201-805). Commerce continued to find all four of the reviewed companies -- Lamina y Placa Comercial, Mueller Comercial de Mexico, Regiomontana de Perfiles y Tubos, and Tuberia Nacional -- had no shipments of subject merchandise to the U.S. during the period of review. As such, these companies' AD cash deposit rates will remain at levels set in previous administrative reviews.
The Commerce Department issued the final results of the antidumping duty administrative review on stainless steel plate in coils from Belgium (A-421-811). Commerce made no changes to the preliminary rate it calculated for sole respondent Aperam. The new rate is effective Dec. 31, and will be implemented by CBP soon.
