The Bureau of Industry and Security added 73 new aircraft to its list of planes that have violated U.S. export controls by flying into Russia, including aircraft owned by Russian cargo carriers, the agency said in an emailed news release. The list includes new planes owned by AirBridgeCargo, which calls itself Russia's largest cargo airline, Atran, a Moscow-based cargo airline, and other commercial or private aircraft owned by Aeroflot, Alrosa, Azur Air, Nordstar, Nordwind, Pegasfly, Pobeda, Rossiya, Royal Flight, S7 Airlines and Utair. BIS also removed 12 aircraft that were allowed to return to owners in partner countries and updated tail numbers for other aircraft to “reflect their purported re-registration in Russia.” The agency said it will impose penalties and/or jail time or revoke export privileges for any company or person that violates the Export Administration Regulations by providing “any form of service” to the aircraft without a required BIS license.
The State Department announced penalties on two people and four foreign entities and their subsidiaries for illegal transfers under the Iran, North Korea and Syria Nonproliferation Act, according to a notice. The agency said the parties transferred items subject to multilateral control lists that contribute to weapons proliferation or missile production. The State Department barred them from making certain purchases of items controlled on the U.S. Munitions List and by the Arms Export Control Act and will suspend any current export licenses used by the entities. The agency also will bar them from receiving new export licenses for any goods subject to the Export Administration Regulations. The restrictions will remain in place for two years from the March 14 effective date.
The Bureau of Industry and Security sent a proposed rule for interagency review that could place new export controls on certain “marine toxins.” The rule, sent for review March 21, proposes changes to the Commerce Control List to reflect revisions recently made at the Australia Group, a multilateral export control group for chemical and biological weapons. If approved by the interagency, the proposed rule will request public comments on the control changes.
The Commerce Department should tighten export restrictions on China’s top chipmaker to prevent it from importing sensitive semiconductor equipment and exploiting a U.S. export control loophole, Sen. Marco Rubio, R-Fla., and Rep. Michael McCaul, R-Texas said. The lawmakers, who voiced similar concerns to Commerce last year (see 2103190005), said in a March 17 letter to Commerce that its export control licensing policies for Semiconductor Manufacturing International Corporation are “ineffective” and are denying less than 1% of export applications to sell technology to the company.

The Bureau of Industry and Security recently launched a landing page for its export control actions against Russia, including relevant fact sheets and guidance. The page also includes agency contact information for industry, a link to request a formal advisory opinion and a list of related regulations and "legal resources." BIS warned that it has imposed controls on a "range of items" subject to the Export Administration Regulations that didn't "previously require export licenses when destined for Russia" and plans to update the page as more restrictions are announced.
The U.S. announced a set of new export controls and sanctions against Russia last week, including new restrictions on luxury goods and full blocking sanctions on Russian government officials and bank executives. The measures, outlined in a March 11 executive order, also include new banking and financing-related restrictions meant to further cut Russia’s economy off from the global financial system and target Russian oligarchs.
Michelle Schulz, a former member of the President's Export Council Subcommittee on Export Administration, rejoined the Braumiller Law Group as of counsel, the firm announced in an email. Schulz was one of the founders of the Braumiller Law Group, helping start the firm in 2003 when it was known as Braumiller Schulz. Schulz also served for a decade as a senior adviser to the Office of the U.S. Trade Representative's Industry Trade Advisory Committee for Aerospace. Her practice deals with export controls, including matters under the International Traffic in Arms Regulations and Export Administration Regulations, along with Foreign Corrupt Practices Act cases and Committee on Foreign Investment in the U.S. regulations, the firm said.
The Bureau of Industry and Security is preparing to issue new export control decisions involving emerging technologies agreed to at the 2021 Wassenaar Arrangement plenary. The interim final rule, sent for interagency review March 8, will harmonize the Commerce Control List with a portion of Wassenaar’s 2021 decisions for certain “recently developed or developing technologies,” BIS said. BIS will implement the remaining Wassenaar 2021 control decisions in a separate rule.
