Tapjoy duped consumers and failed to provide promised in-game rewards, the FTC alleged in a 5-0 settlement Thursday. The mobile ad company is “prohibited from misleading users” about rewards and “must monitor” third-party ad partners to “ensure they do what is necessary to enable Tapjoy to deliver promised rewards to consumers.” There was no monetary penalty, but the company faces fines up to $43,280 for subsequent violations of the consent order. “The settlement proposed today should help reverse the lax policing practices that led hundreds of thousands of gamers to file complaints,” said Commissioners Rohit Chopra and Rebecca Kelly Slaughter: The agency must address “deeper structural problems” and should continue to scrutinize ad middlemen and app stores. An attorney for the company didn’t comment.
Amazon was promoting a 1080p 3LCD projector from Epson Home Cinema Wednesday at $643.63, or 8% off its $699.99 list. The model 1060 projector touts 3,100 lumens of color/white brightness from an operating distance of 19 feet, plus built-in speakers and two HDMI ports, said Amazon. Third-party seller Tek Deals is fulfilling orders, said Amazon. Epson American brought suit in Florida just before Christmas against another Amazon third-party seller, Stratton AV, for allegedly giving the Epson brand a bad name by advertising and offering for sale various Epson projectors through its Hatchfields online store but without Epson inventory or authorization to sell the goods to consumers (see 2012230025). Epson didn't respond to questions seeking verification that Tek Deals is an authorized Epson reseller on Amazon.
Dish Network said it will follow a National Advertising Division recommendation and drop or modify some express and implied claims for its Hopper 3 DVR. NAD said Wednesday AT&T brought the complaint, and while Dish maintained it was comparing only cloud DVRs, many consumers likely would see the comparative claims as also encompassing hardware DVRs. Dish emailed us it "believes in the self-regulatory process and will comply with NAD’s decision," but it is "disappointed that our considerable consumer evidence was completely discounted."
