Search Primer

Term list: Separate terms with spaces, not commas or semicolons.

Multi-word term: Place inside quotes to ensure an exact match (e.g. "China import").

Acronyms: Use all capital letters to ensure the search is not looking for that letter sequence instead.

Required term: If a term must be included in any resulting articles, prefix it with a plus sign (e.g., +CBP).

Excluded term: If a term should be excluded from any articles being found, prefix it with a minus sign (e.g., -ruling).

Singular form: Always use the singular form when doing multi-word terms (e.g. "russian export control" instead of "russian export controls").

Shortest word form: When you have different word forms in a quoted (multi-word) term, you want to only include the shortest version if it is the last part of the expression (e.g., "entity list" instead of "entity listing" or "entity listed").

CBP Finds Country of Origin of Malaysian Software Products is U.S. for Government Procurement

Four cybersecurity software products from a Malaysian company are considered of U.S. origin for government procurement purposes, said CBP in a final determination (here). The “source code” is written in Malaysia while the “object code” is compiled in the U.S. "CBP has consistently held that conducting a ‘software build’ -- i.e., compiling source code into object code -- results in a substantial transformation," the agency said. As a result, the finished software products are determined to be of U.S. origin, said CBP.

CBP Releases Guidance on Recordkeeping in ACE

CBP posted a policy guidance on recordkeeping requirements in the Automated Commercial Environment (here). "As a matter of policy, CBP will not request an entry filer to produce the data (formerly contained in CBP Forms 7501, 3461, 214 or 7512) that the filer previously transmitted to and was retained by CBP unless CBP has a need for such records," the agency said. If CBP does need such records, the filer can retransmit or provide the data through an ACE report, it said. The guidance applies only to "entries/entry summaries and [Foreign Trade Zone] admissions filed in ACE," said CBP. "Supporting documentation that was used to create the data transmitted to CBP must be maintained by the filer and is not covered by this recordkeeping guidance regardless of whether the entry or FTZ admission was filed in ACE or ACS." CBP also noted that "entry data and information previously presented to and retained by CBP is not subject to a recordkeeping penalty for non-production if such data or information is subsequently requested." The way in which a broker or filer provides copies of the transmissions to the importer of record will be up to those parties, said CBP. The guidance doesn't apply to "the recordkeeping requirements or entry/entry summary production requirements of the United States Court of International Trade," said CBP.
