Russia export controls and sanctions
The use of export controls and sanctions on Russia has surged since the country's invasion of Crimea in 2014, and especially its invasion of Ukraine in in February 2022. Similar export controls and sanctions have been imposed by U.S. allies, including the EU, U.K. and Japan. The Court of International Trade affirmed the International Trade Commission’s final negative determinations in the second sunset reviews of the antidumping and countervailing duty orders on hot-rolled flat-rolled carbon-quality steel products from Brazil and Japan, which resulted in revocation of the AD and CV suspension agreements for Brazil (A-351-828 / C-351-829) and the AD order for Japan (A-588-846). The domestic plaintiffs contested nearly every element of the ITC’s analysis, including the ITC’s decision not to cumulate the volume and effect of subject imports between the countries subject to the sunset review (which included Brazil, Japan and Russia), the likely volume and price effects of imports if the agreements and order were revoked, the vulnerability of domestic industry, and the likelihood of adverse impact, but CIT said the ITC’s determinations in each of these analyses were supported by substantial evidence. As such, CIT deferred to the ITC, and dismissed the challenge.
The International Trade Administration is set to revoke the antidumping duty order on ferrovanadium and nitrided vanadium from Russia (A-821-807), after the International Trade Commission voted Aug. 8 that revocation wouldn’t lead to injury to U.S. industry. The ITC’s negative determination was unanimous. The ITA will publish a notice in the Federal Register revoking the AD order on ferrovanadium and nitrided vanadium from Russia effective Oct. 13, 2011, which is five years from the publication date of the previous continuation notice of the AD order.
Pfizer subsidiary Pfizer H.C.P. Corp. agreed to pay a $15 million penalty to resolve an investigation of Foreign Corrupt Practices Act (FCPA) violations, said Principal Deputy Assistant Attorney General Mythili Raman of the Justice Department's Criminal Division. Pfizer Inc. and Wyeth LLC also reached settlements with the Securities and Exchange Commission under which Pfizer Inc. agreed to pay more than $26.3 million, including interest, to resolve concerns involving the conduct of its subsidiaries. Wyeth, which had been acquired by Pfizer Inc. in 2009, agreed to pay $18.8 million, including interest, to resolve concerns involving the conduct of Wyeth subsidiaries.
Imports from Russia of vanadium pentoxide produced by the Evraz Group, which are converted into ferrovanadium in the U.S. by Bear Metallurgical Corporation, are not circumventing the antidumping duty order on ferrovanadium and nitrided vanadium from Russia (A-821-807), the International Trade Administration said in the negative final determination of an anti-circumvention inquiry. The ITA said the toll-conversion process in the U.S. is not minor or insignificant. The merchandise will therefore not be included in the scope of the AD order.

House Majority Leader Eric Cantor (R-Va.) hopes to progress legislative efforts in September on granting Permanent Normal Trade Relations (PNTR) to Russia, he said in a statement. The House Ways and Means Committee and the Senate Finance Committee have approved similar legislation to give PNTR to Russia. "Upon our return from the August constituent work period, the House is prepared to take up under suspension of the rules a bill to extend [PNTR] to Russia, combined with the Sergei Magnitsky Rule of Law Accountability Act, should the Senate and President commit to support passage before the end of September."
