The Commerce Department and the International Trade Commission published the following Federal Register notices Dec. 27 on AD/CVD proceedings:
Attorneys for plaintiff Catherine Migliano and for defendant Parler in Migliano’s Telephone Consumer Protection Act class action against the social media platform “engaged in some preliminary settlement discussions, but have not pursued the matter further, or discussed class settlement in particular,” they said in a joint scheduling report Thursday (docket 0:22-cv-61805) in U.S. District Court for Southern Florida for Fort Lauderdale. Lawyers for both sides “believe that this is a standard track case” and that all discovery should be completed by Aug. 11, said the report.
U.S. District Judge William Orrick for Northern California in San Francisco signed an order Thursday (docket 3:22-cv-03580) denying the plaintiffs in a privacy class action their Aug. 25 motion for a preliminary injunction to enjoin Meta from intercepting and disseminating their patient information via the Pixel tracking tool. The plaintiffs represent one of seven consolidated cases.
The Court of International Trade in a Dec. 22 opinion granted plaintiff Aluminum Extrusions Fair Trade Committee's motion for a preliminary injunction in an Enforce and Protect Act case. Judge Richard Eaton ruled that the plaintiff sufficiently proved that it will be "immediately and irreparably" harmed without the injunction barring liquidation of importer Kingtom Aluminio's aluminum extrusions until the litigation has ended. The judge further ruled that the industry group has a "'fair chance' of success on the meritsm" given that there have been several cases with the same merchandise and parties where CBP has asked for voluntary remand or reversed itself.
U.S. District Judge Edward Davila for Northern California in San Jose signed a joint stipulation and order Wednesday (docket 5:22-cv-04325) extending by another month the temporary restraining order previously stipulated by the FTC and Meta in the commission’s lawsuit to block Meta’s Within Unlimited buy. The TRO means Meta and Within agree not to consummate or close their proposed transaction until after 11:59 p.m. PST Jan. 31, or until the first business day after Davila rules on the FTC’s request for a preliminary injunction, said the stipulation.
The Commerce Department intends to end antidumping duties on polyethylene terephthalate (PET) sheet from the Sultanate of Oman (A-523-813), it said in the preliminary results of a changed circumstances review. Advanced Extrusion, Inc., Good Natured Products and Multi-Plastics Extrusions, original petitions for the AD order, requested the revocation in October. If Commerce decides to revoke the order in the final results of its changed circumstances review, it will "liquidate without regard to antidumping and countervailing duties" and "refund any estimated deposits of those duties, on all unliquidated entries of the merchandise ... that are not covered by the final results of an administrative review or automatic liquidation," it said.
The Court of International Trade in a Dec. 22 opinion granted plaintiff Aluminum Extrusions Fair Trade Committee's motion for a preliminary injunction in an Enforce and Protect Act case. Judge Richard Eaton ruled that the industry group sufficiently proved that it will be "immediately and irreparably" harmed without the injunction barring liquidation of importer Kingtom Aluminio's aluminum extrusions until the litigation has ended. The judge also ruled that "it cannot be said at this time that Plaintiff does not have a 'fair chance' of success on the merits" given CBP has asked for voluntary remand or reversed itself in several cases with the same merchandise and parties.
