The Commerce Department is setting new countervailing duty cash deposit requirements for imports of melamine from Germany, India, Qatar, and Trinidad and Tobago (C-428-853, C-533-925, C-518-002, C-274-811), after finding countervailable subsidization of producers and exporters in the four countries in the preliminary determinations of its CVD investigations. Suspension of liquidation and cash deposit requirements will generally take effect for entries on or after July 22, the date that the preliminary determinations are set to be published in the Federal Register, but Commerce is making the suspension of liquidation and CVD cash deposits retroactive to approximately April 21 for Indian companies.
The Commerce Department issued antidumping duty orders on paper shopping bags from Cambodia (A-555-002), China (A-570-152), Colombia (A-301-805), India (A-533-917), Malaysia (A-557-825), Portugal (A-471-808), Taiwan (A-583-872) and Vietnam (A-552-836), and countervailing duty orders on paper shopping bags from China (C-570-153) and India (C-533-918).
California’s age-appropriate design law doesn’t violate the First Amendment because it regulates social media data practices, not content, the office of Attorney General Rob Bonta (D) argued Wednesday before the 9th U.S. Circuit Court of Appeals. The court’s three-judge panel suggested the First Amendment applies.
The Commerce Department issued notices in the Federal Register on its recently initiated antidumping and countervailing duty investigations on brake drums from China and Turkey (A-570-174/C-570-175, A-489-853/C-489-854). The CVD investigations cover entries for the calendar year 2023. The AD investigation on Turkey covers entries April 1, 2023, through March 31, 2024, and the AD investigation on China covers entries Oct. 1, 2023, through March 31, 2024.
The Commerce Department soon will suspend liquidation and impose countervailing duty cash deposit requirements on imports of melamine from Germany, India, Qatar and Trinidad and Tobago, it said in a fact sheet issued July 16. Commerce set CVD rates at 29.72% for all German exporters, 17.09% for all Indian exporters, 40.49% for all Qatari exporters and 5.13% for all Trinidadian exporters, the agency said as it announced its preliminary determinations in its ongoing CVD investigations. Suspension of liquidation and cash deposit requirements will take effect for entries on or after the date of publication of the preliminary determinations in the Federal Register, which should occur in the coming days.
Allowing Mississippi to enforce its new age-verification law would cause irreparable harm in violation of the First Amendment, a federal judge ruled Monday in a victory for NetChoice (see 2407030076) (docket 1:24-cv-170-HSO-BWR). The tech association is suing to block HB-1126, which requires that platforms obtain parental consent for social media users younger than 18. The U.S. District Court for Southern Mississippi on July 1 granted NetChoice’s request for a preliminary injunction against HB-1126, finding the association is likely to succeed on the merits of its First Amendment challenge. District Judge Halil Suleyman Ozerden on Monday denied a request from Mississippi Attorney General Lynn Fitch (R) to stay the preliminary injunction. Ozerden cited previous findings stating that the plaintiff’s “loss of First Amendment freedoms, for even minimal periods of time, unquestionably constitutes irreparable injury. ... For the same reasons it granted preliminary injunctive relief, the Court finds that the Attorney General is not likely to succeed on the merits of the appeal.”
The Commerce Department will conclude its countervailing duty investigation on mattresses from Indonesia without imposing a CVD order, it said in a fact sheet announcing its final negative determination in the CVD investigation, as well as affirmative antidumping duty investigations for four other countries. For those other four countries, the agency amended some AD rates from its preliminary determinations, setting them at 13.35% to 42.76% for India, 63.66% to 344.7% for Kosovo, 37.59% to 61.97% for Mexico and 4.61% to 280.28% for Spain. The amended rates will be effective upon publication of these final determinations in the Federal Register in the coming days. Commerce issued AD orders for mattresses from eight other countries on July 11 (see 2407160012).
The Court of International Trade in a confidential July 15 order denied customs broker Seko Customs Brokerage's application for a temporary restraining order and preliminary injunction against CBP's temporary suspension of the company from the Entry Type 86 pilot and the Customs-Trade Partnership Against Terrorism program. Judge Claire Kelly said she intends to issue a public version of the opinion "on or shortly after" July 23, giving the litigants until July 22 to review the confidential information in the decision (Seko Customs Brokerage v. U.S., CIT # 24-00097).
