Germany’s competition authority Bundeskartellamt will review Liberty Global’s planned acquisition of Kabel Baden-Wurttemberg (KBW), the European Commission said Friday. Germany asked that the commission refer the proposed transaction to its own competition authority for review. Liberty already owns Kabel Deutschland, and the deal would consolidate the country’s second- and third-largest regional cable operators, the commission said. A preliminary EC investigation found that the deal might “significantly affect competition for retail supply of free-TV services to housing associations in Germany,” the commission said. Though regional operators don’t compete against each other, “it cannot be excluded that this is the result of co-ordination among the operators and that the proposed transaction could strengthen such coordinated efforts between the three regional operators,” the commission said. The deal could also affect competition for national TV programming, it said.

Cliff Stearns, R-Fla., said he saw Bono Mack’s version as an overreaction to recent breaches of Sony and Epsilon. But both sides said they hoped to reach consensus.
