Rulings and pending cases involving rebroadcasting TV over the Internet have huge implications for the TV industry and copyright law, and could be headed for the Supreme Court, said several communications attorneys at an FCBA event Wednesday night. On Monday, the 2nd U.S. Circuit Court of Appeals upheld a lower court decision denying broadcasters a preliminary injunction against Aereo, which lets customers watch New York City-area TV broadcasts online by leasing them personal DVRs and antennas (WID April 2 p3). However, in December, a similar injunction against a competing Internet TV company called Aereokiller was upheld in U.S. District Court in Los Angeles.
The International Trade Administration issued the preliminary results of its countervailing duty administrative review on drill pipe from China (C-570-966) for Shanxi Yida Special Steel and its affiliates. These CV rates are not in effect. The ITA may modify them in the final results of this review and change the estimated CV cash deposit rates for these company.

The Court of International Trade denied the Wind Tower Trade Coalition’s request for preliminary injunction against liquidation of entries of merchandise subject to the antidumping and countervailing duty investigations on utility scale wind towers from China and Vietnam, but made during the provisional measures period. The court had temporarily enjoined liquidation of the entries March 4, because of a pending challenge to the effective date of the AD/CV duty orders resulting from the investigations (see 13030820). Because of the injury vote in the investigations, the orders did not cover entries made between the preliminary determination and the AD/CV duty orders.

The Food Safety and Inspection Service’s pilot on electronic filing of import inspection applications through the Automated Commercial Environment (ACE) will begin in summer 2013, and will include all products under FSIS jurisdiction, including meat, poultry, and processed egg products, the agency said. While FSIS doesn’t currently plan to restrict the number of participants, it may do so based on the number of volunteers responding to the request for participation in the pilot, it said. And although the Federal Register notice announcing the pilot said requests to participate are due by May 28 (see 13032829), FSIS will evaluate any request to volunteer for the pilot, including late requests, and “consider such requests appropriately,” the agency told us.
The Court of International Trade granted the Diamond Sawblades Manufacturing Coalition’s request for a preliminary injunction to prevent liquidation of entries of diamond sawblades from China produced and/or exported by Advanced Technology & Materials Co., Ltd., but denied the coalition’s request for an injunction against revocation of the antidumping duty order for the company.
The International Trade Administration issued the final results of the countervailing duty administrative review of corrosion-resistant carbon steel flat products from South Korea (A-580-818). All three reviewed companies received de minimis CV rates, so entries of subject merchandise produced and exported by these companies will be liquidated without regard to CV duties. Also, because the ITA recently revoked the CV duty order on corrosion-resistant carbon steel flat products from Korea effective Feb. 14, 2012 (see 13031815), CV duty cash deposits will not be required on entries of subject merchandise.
