The House is poised to move on legislation to repeal country-of-origin (COOL) labeling in the coming weeks, but the Senate will be a bigger obstacle, even as Canada and Mexico are ready to retaliate on a laundry list of U.S. exports, said U.S. industry representatives in May 26 interviews. The World Trade Organization dealt a final blow to the U.S. with its rejection of an appeal roughly ten days ago (see 1505180018). The WTO’s Dispute Settlement Body will now consider and likely adopt the rejection at a meeting on May 29 (here), a procedural step that will pave the way for retaliation.

The Senate will “resume consideration” of the motion to authorize trade debate on May 13, after Senate Democrats fell in line behind Minority Leader Harry Reid, D-Nev., and shot down the procedural vote the day before. Sen. Tom Carper, D-Del., was the lone Democrat to break ranks on May 12 and support the measure, which failed with only 52 votes in favor. Majority Leader Mitch McConnell, R-Ky., needed 60 votes to move the chamber to debate on trade legislation.

Newly introduced Trade Promotion Authority legislation would strengthen Congress' ability to slow trade agreement implementation bills, lawmakers and congressional aides said. The heavily-anticipated legislation, introduced on April 16, will also give the American public improved access to trade negotiations and lead the way for a number of other trade measures. Aside from procedural and transparency modifications, the bill largely mirrors the TPA legislation introduced in the last Congress, as many lawmakers and trade experts predicted (see 1501300023).
