Forced Labor

CBP is the primary U.S. agency tasked with combating forced labor in international trade. It is the only agency with legal authority to take enforcement action and prevent entry into domestic commerce of goods produced with forced labor. CBP combats forced labor by issuing Withhold Release Orders (WROs) and Findings, and enforcement of the Uyghur Forced Labor Prevention Act (UFLPA), and Countering America’s Adversaries Through Sanctions Act (CAATSA). Goods subject to WROs and Findings, UFLPA, and CAATSA status cannot be entered at any ports of the U.S.

Search Primer

Term list: Separate terms with spaces, not commas or semicolons.

Multi-word term: Place inside quotes to ensure an exact match (e.g. "China import").

Acronyms: Use all capital letters to ensure the search is not looking for that letter sequence instead.

West Coast Dock Workers Union Ratifies Labor Contract With PMA

The International Longshore and Warehouse Union on Aug. 31 officially voted to ratify the tentative labor agreement they reached with the Pacific Maritime Administration in June (see 2306150038), the ILWU said. The union said it voted 75% in favor of the new deal, which expires July 1, 2028, adding that it "protects good-paying jobs in 29 West Coast port communities, maintains health benefits, and improves wages, pensions and safety protections."

CBP Announces New Fentanyl Dashboard

CBP released a new dashboard about the dangers of fentanyl, acting CBP Commissioner Troy Miller said in a press release Aug. 31. The dashboard "will better inform the public, our partners, and key stakeholders about the dangers of fentanyl -- which can ultimately save lives," Miller said. The goal of the new dashboard is to highlight "law enforcement’s ability to fight against fentanyl and other opioids" and also help provide science and treatment professionals with "crucial information" to communicate about the opioid epidemic more effectively, Miller said. CBP will continue to work with their partners to fight the opioid epidemic and "prevent more senseless deaths," he said.

US Company Accuses Danish Carrier of Violating Shipping Laws, Overcharging by $900,000

Connecticut-based electronics manufacturer Hubbell Inc. accused freight forwarder DSV of violating U.S. shipping regulations by failing to provide the required service under a negotiated contract, Hubbell said in an Aug. 28 complaint to the Federal Maritime Commission. The manufacturer also accused DSV, headquartered in Denmark, of assessing $900,000 in overbilled or “improper” charges.

Trade Groups Warn L.A. and Long Beach Against Restrictions on Port Activity

Over 100 organizations led by the Pacific Merchant Shipping Association (PMSA) signed a letter urging the mayors of Los Angeles and Long Beach to oppose a "potential Indirect Source Rule (ISR)" by the South Coast Air Quality Management District (SCAQMD). In the letter to the mayors written Aug. 25, groups that include the National Customs Brokers & Forwarders Association of America warned that the ISR would have a "devastating impact" on jobs in California, the supply chain, the economy, the transition to "zero-emissions" equipment, the competitiveness of the ports, and the "economic vitality of Port-adjacent communities."

Forced Labor Task Force Should Exercise 'Restraint' for Entity List, Lawyer Says

The Forced Labor Enforcement Task Force (FLETF) should "exercise restraint" in putting entities on the Uyghur Forced Labor Prevention Act Entity List and focus only on companies that are "clearly implicated" in the use of forced labor, international trade lawyer John Foote said in a blog post Aug. 28.The blog post focuses on Ninestar Corporation's case against FLETF and the potential impact of being included on the Entity List (see 2308230016).
