Forced Labor

CBP is the primary U.S. agency tasked with combating forced labor in international trade. It is the only agency with legal authority to take enforcement action and prevent entry into domestic commerce of goods produced with forced labor. CBP combats forced labor by issuing Withhold Release Orders (WROs) and Findings, and enforcement of the Uyghur Forced Labor Prevention Act (UFLPA), and Countering America’s Adversaries Through Sanctions Act (CAATSA). Goods subject to WROs and Findings, UFLPA, and CAATSA status cannot be entered at any ports of the U.S.

Clear Terms

Search Primer

Term list: Separate terms with spaces, not commas or semicolons.

Multi-word term: Place inside quotes to ensure an exact match (e.g. "China import").

Acronyms: Use all capital letters to ensure the search is not looking for that letter sequence instead.

Required term: If a term must be included in any resulting articles, prefix it with a plus sign (e.g., +CBP).

Excluded term: If a term should be excluded from any articles being found, prefix it with a minus sign (e.g., -ruling).

Singular form: Always use the singular form when doing multi-word terms (e.g. "russian export control" instead of "russian export controls").

CBP Targets $125M Worth of Shipments for Suspected Forced Labor in November

CBP in November identified 331 shipments valued at more than $125 million for further examination based on the suspected use of forced labor, including goods subject to the Uyghur Forced Labor Prevention Act and withhold release orders, the agency said in its most recent operational statistics update. The value of those shipments is down from October, when CBP identified 504 shipments worth more than $199 million (see 2311140053). Also in November, CBP seized 1,607 shipments that contained counterfeit goods valued at more than $118 million if the items had been genuine, the agency said.

EAPA Investigation Finds Duty Evasion by Xanthan Gum Imports

Adi Chemtech evaded an antidumping duty order on xanthan gum from China, CBP said in the final determination of an Enforce and Protect Act investigation. The agency said it found substantial evidence that the importers had transshipped Chinese-origin xanthan gum through India, necessitating the imposition of interim measures.

AMS Publishes Update to Organic CATAIR Guidelines

The USDA's Agriculture Marketing Service published an update to its CBP and Trade Automated Interface Requirements (CATAIR), CBP said in a CSMS message on Dec. 19. The guidelines, which were published on Dec. 12, included information added for an "OR2" message set, "related to data submitted for the National Organic Program," CBP said.

EPA HFC Code to Be Deployed on Jan. 13, CBP Says

EPA's hydrofluorocarbons code will deploy to CBP's production environment on Jan.13 (see 2312050063), CBP said in a CSMS message Dec. 19. The HFC code has been deployed in the ACE certification environment as of Dec. 5. The EPA HFC flags (EH1, EH2) will be enforced with a reject severity following the deployment, CBP said.
