After seeking supplemental evidence from both parties, the Commerce Department on remand continued to find that an Indian frozen shrimp exporter had no reason to believe its home market sales of unbranded shrimp were destined for any location other than India. It kept the exporter’s antidumping duty rate at 7.92%, pending the trade court’s approval (Ad Hoc Shrimp Trade Action Committee v U.S., CIT Consol. # 23-00202).
Imports of frozen warmwater shrimp materially injure a U.S. industry, the ITC announced Nov. 19 at the conclusion of its AD/CVD Investigation. The ITC reached this determination following a Commerce Department finding that imports from Indonesia are sold in the U.S. at less than fair value and imports from Ecuador, India and Vietnam are subsidized by their governments (see 2410280026). As a result, the Commerce Department will issue countervailing duty orders on frozen warmwater shrimp imports from Ecuador, India and Vietnam and an antidumping duty order on those imports from Indonesia.
