21st Century Customs Framework
The 21st Century Customs Framework is a CBP initiative that seeks to modernize the flow of goods into the United States. The goals of the initiative are to enhance facilitation and security, ensure seamless data sharing, increase visibility into modern supply chains, provide enforcement flexibility and streamline processes to deter bad actors and protect U.S. consumers and businesses from unfair competition, and secure additional funding. CBP created a task force representing U.S. businesses which recommended a series of legislative proposals eventually codified into law in the Customs Modernization Act of 2023.
LAREDO, Texas -- CBP hopes to wrap up discussions with the trade on its 21st Century Customs Framework in 2023, “putting a bow” on its consultations with the Commercial Customs Operations Advisory Committee and putting legislative proposals to Congress, said Brandon Lord, CBP executive director-trade policy and programs.
The E-Merchants Trade Council released on Nov. 28 a detailed “redline” of proposed changes to the customs laws that the trade group is proposing to the 21st Century Customs Framework Task Force as it works with CBP to develop draft customs modernization legislation. The document puts “into specific statutory text EMTC’s recommendations on the Customs Modernization Act of 2021,” the EMTC said in its introduction.
The Commercial Customs Operations Advisory Committee (COAC) will not move forward with a proposal under the 21st Century Customs Framework (21CCF) to make ocean vessel manifest data automatically confidential, according to a report from the 21CCF task force released by the COAC Nov. 28. The provision is one of several listed by the task force in the report that the COAC will no longer advance after recent discussions with CBP.

Trade participants in the 21st Century Customs Framework “focus group” are set to meet with CBP and other government officials Oct. 17 and 18 to discuss a series of proposed statutory changes developed over recent weeks that aim to incorporate facilitation measures into upcoming customs modernization legislation.
As the finish line comes into sight for discussions with CBP on enforcement-related agency “challenge areas” under the 21st Century Customs Framework (21CCF), trade community participants now seek to steer the discourse toward facilitation and modernization opportunities that may prove crucial to getting buy-in from the trade industry.
CBP hopes that its 19 CFR 111 customs broker modernization final rule will go for publication "at any moment," and it will hold "multiple webinars" on the new regulations, which are set to eliminate district permits, to provide details on the rule as it is published, CBP Deputy Commissioner Troy Miller said at the Sept. 14 meeting of the Commercial Customs Operations Advisory Committee.
