The Commerce Department and the International Trade Commission published the following Federal Register notices Dec. 19 on AD/CVD proceedings:

The Court of International Trade on Dec. 19 denied importer Lionshead Specialty Tire & Wheel's bid to amend a preliminary injunction that suspends liquidation of certain trailer wheel entries to not enjoin liquidation of wheel entries found by the Commerce Department to fall outside the scope of the AD/CVD orders on steel trailer wheels from China. The matter arose in Lionshead's suit against CBP's determination that various importers evaded the AD/CVD on Chinese trailer wheels. Judge Gary Katzmann said Lionshead failed to show "changed circumstances that warrant the modification of the preliminary injunction."

The Commerce Department has released the preliminary results of its countervailing duty administrative review on forged steel fluid end blocks from Germany (C-428-848). Commerce preliminarily calculated a CVD rate of 3.51% for BGH Edelstahl Siegen GmbH and its cross-owned affiliates, the only company still covered by the review. Any changes to BGH's cash deposit rates would take effect on the publication date of the final results of the review. Once Commerce issues its final results of this review, the agency will assess CVD for entries of subject merchandise from BGH entered Jan. 1, 2023, through Dec. 31, 2023, it said.

The Commerce Department is beginning an anti-circumvention inquiry to determine whether all imports of oil country tubular goods from Thailand made from Chinese steel billets are circumventing antidumping and countervailing duties on oil country tubular goods from China (A-570-943/C-570-944), it said Dec. 18.

The Commerce Department soon will suspend liquidation and impose countervailing duty cash deposit requirements on imports of tungsten shot from China, it said in a fact sheet issued Dec. 17. CVD rates range from 73.75% to 352.2% for Chinese exporters, the agency said as it announced its preliminary determinations in its ongoing CVD investigations. Suspension of liquidation and cash deposit requirements will take effect for entries on or after the date of publication of the preliminary determinations in the Federal Register, which should occur in the coming days. Commerce is conducting a concurrent AD investigation of the same, with a preliminary determination expected by Feb. 12.

The Commerce Department failed to justify its de facto specificity finding regarding the South Korean government's provision of electricity below cost in the 2021 review of the countervailing duty order on cut-to-length carbon-quality steel plate from South Korea, the Court of International Trade held in a decision made public Dec. 17. Judge Claire Kelly said Commerce didn't lay out a "rational basis" for grouping certain industries together and declaring that the selected industries received a disproportionate benefit from the program.

The Court of International Trade upheld Dec. 17 the Commerce Department’s decision to swap back to the model match methodology it had used earlier in a review of antidumping duty orders on superabsorbent polymers from South Korea. The change meant administrative review mandatory respondent LG Chem’s AD rate jumped back up, from 17.64% to 26.05%.

The Commerce Department has published the final results of the antidumping duty administrative review on corrosion-resistant steel products from South Korea (A-580-878). These final results will be used to set final assessments of AD duties on importers for subject merchandise entered July 1, 2022, through June 30, 2023.
