The Senate confirmed John Kelly as secretary for the Department of Homeland Security on Jan. 20 (here), and he was sworn in the same day, DHS said in a news release (here). Kelly will effectively oversee CBP and ICE, both mostly housed within DHS, as part of his role in the Trump administration.
Kevin McAleenan became acting commissioner at CBP on Jan. 20, CBP said (here). The transition for McAleenan, from deputy commissioner to acting commissioner, was expected (see 1611090035). Randolph Alles, previously CBP's acting executive assistant commissioner for the Enterprise Services Office, became acting deputy commissioner also on Jan. 20, CBP said (here). Kathryn Kolbe, previously in the Department of Homeland Security Office of the Chief Readiness Support Officer, will take over in the Enterprise Services Office, CBP said (here).

In the Jan. 18 issue of the CBP Customs Bulletin (Vol. 51, No. 3) (here), CBP published notices that propose to revoke or modify rulings and similar treatment on the application of Jones Act coastwise laws to certain merchandise and vessel equipment that are transported between coastwise points. The Jones Act limits activities by foreign-flagged vessels around the U.S. CBP also posted four related rulings (here) that aren't available on CBP's ruling database.

CBP issued the following release on commercial trade and related matters:
CBP clarified that the Fish and Wildlife Service suspended both its ACE import and export pilots as of Jan. 12 (here). CBP also reiterated that FWS would take a new interim approach to tariff flagging. "Those tariff codes currently flagged as 'FW2' associated with government agency processing code EDS will remain flagged as FW2 and require the FWS 'EDS' Message Set in all cases," CBP said. "All other tariff codes currently flagged as 'FW2' will shift to 'FW1' with the ability to file a newly created disclaimer code 'E' that is specific to FWS or the EDS. FWS is working with CBP to program the inclusion of the FWS Designated Port Exception Permit. The timeline for implementation is dependent upon revision of the FWS Implementation Guide and CBP programming." FWS recently announced it would bring back its the designated port permitting to allow for entries at port without FWS staff present (see 1612140064).
