The two types of storage products found to be from Mexico were "substantially transformed in Mexico mainly because of the assembly of the various components," CBP said. Malaysia is the country of origin for the other product because, while some of the assembly still occurs in Mexico, the product "lacks the disc drive assemblies, which make up a significant part of the assembly process," the agency said. For NAFTA marking purposes, "since the three products undergo production other than minor processing in Mexico," the "country of origin for all three products for marking purposes will be Mexico," it said.

The country of origin of aircraft manufactured in Brazil and modified in the U.S. so it can be used for fire suppression is Brazil for government procurement purposes, CBP said in a final determination (here). The KC-390 is produced by Embraer in Brazil for use as a medium military aircraft, CBP said. The aircraft are imported and modified in Texas, including by removing electronics systems required for military use and adding components to meet requirements for aerial firefighting. CBP found that, despite the changes, ”the most important systems of the KC-390 will remain intact.” The structural integrity and aerodynamics of the aircraft, such as size and shape and wingspan, will not be changed. Nor will the engine powering the aircraft nor electronics and instruments involved in flying the aircraft be significantly changed, CBP said.
The U.S. is the country of origin for government procurement purposes of a workstation that can be used in the sitting or standing positions, CBP said in a final determination (here). The workstation is made from a lift assembly imported from China that is used to change the position of a U.S.-made particle board work surface and keyboard tray. The processes that occur in the U.S. include sawing, profiling, sanding, hot-pressing and trimming to manufacture the work surface and keyboard tray as well as laser-cutting, bending and painting of the sheet metal components followed by final assembly of the U.S. origin and the imported components, CBP said. Those products substantially transform the workstation, it said. “The lift assembly is not functional to an end user by itself as it does not include the primary features of the U.S. origin work surface and keyboard tray which allow the work to be conducted, and without which, the lifting mechanism is incapable of being used as a workstation,” CBP said.
