Merging ACE accounts does not result in the loss of any historical data, a CBP spokesman said in a recent email in response to a law firm's blog post on the subject (see 1710130025). CBP said it wanted "to correct and clarify the information in the Baker McKenzie blog" on how historical ACE data is handled once ACE accounts are merged following a company merger or acquisition. Specifically, "the ACE Portal merge feature does not create a new account, it consolidates data under the acquiring company’s account," it said. Also, "no historical transactional data from the acquired company is deleted or eliminated from ACE" and "CBP makes access solely available to the acquiring company."

CBP will adopt a final rule to set procedures in its regulations for adjusting Consolidated Omnibus Budget Reconciliation Act (COBRA) fees for inflation, the agency said in a notice. The final rule includes three changes to the proposed version (see 1707140037), it said. CBP extended the time frame for publishing notice specifying the amount of the fees and limitations to at least 60 days prior to the effective date, and made two changes related to how it calculates fees. The inflation adjustments and fee limitations were required by the Fixing America's Surface Transportation Act, passed in 2015 (see 1512040024).
CBP will increase Consolidated Omnibus Budget Reconciliation Act (COBRA) fees by 2.677 percent to adjust for inflation in fiscal year 2018, the agency said in a notice. Affected fees include the merchandise processing fee, vessel and truck arrival fees and the customs broker permit user fee. The Fixing America's Surface Transportation Act, passed in 2015, required that CBP make inflation adjustments and fee limitations when deemed necessary (see 1512040024).
