CBP posted a list of frequently asked questions related to changes to the agency's in-bond regulations (see 1709270027). The list addresses questions on local port policy differences, diversion requests, implementation of Harmonized Tariff Schedule number requirements and partner government agency visibility into in-bond transactions. While the rules took effect Nov. 27, CBP said it wouldn't immediately begin enforcing the requirements (see 1711220043).
Planned revisions for CBP Form 5106 remain in limbo as work continues to get final approval, a CBP spokesman said in an email. CBP proposed in 2015 changing the name of the form from Importer ID Input to Create/Update Importer Identity Form and adding some new data fields to allow for more detailed information (see 1507240009). "At this time, the proposed 2015 modifications of the CBP form 5106 are not effective," the spokesman said. "We are working through the interagency process to make the modifications." An Office of Information and Regulatory Affairs notice earlier this year listed the information collection request as "withdrawn and continue" (see 1706020010).

CBP’s adoption of new questions in its informed compliance publication on reasonable care sets the stage for increased enforcement on importers of recently amended provisions banning imports of goods produced with forced labor, customs lawyer Ted Murphy of Baker McKenzie said in a blog post. Importers that cannot answer the questions, which address an importer’s knowledge of its supply chain and procedures to check for forced labor (see 1711070046), “run the risk of having their goods detained or seized,” Murphy said.
