The CBP Pharmaceutical, Health and Chemicals Center of Excellence and Expertise found some problems with entries using special indicator codes (SPIs), CBP said in its trade enforcement bulletin for the second quarter of fiscal year 2018. The Center finished a free trade agreement enforcement operation nicknamed "38 Special" that "targeted Chapter 38 entries where the use of a special [program] indicator was applied," CBP said. Chapter 38 covers "miscellaneous chemical products."

CBP created Harmonized System Update (HSU) 1808 on May 31, containing 11,876 Automated Broker Interface records and 2,228 harmonized tariff records, it said in a CSMS message. Modifications include changes related to May 31 Presidential Proclamations for tariffs on steel and aluminum (see 1805310028), CBP said. "Regulations related to alcohol administered by [the Alcohol and Tobacco Tax and Trade Bureau] are included, and the ACE HTS has been updated to reflect these changes," CBP said. CBP was waiting for TTB guidance to implement excise tax cuts for beer, wine and distilled spirits that took effect Jan. 1 (see 1801190020).
Fifty-seven categories of goods subject to new quotas on steel from Argentina and Brazil are already filled, CBP said in a notice. Thirty-nine of those categories apply to steel from Argentina and 18 apply to steel from Brazil. The quotas on steel from those countries took effect on June 1 (see 1805310028). The quotas account for imports since Jan. 1, 2018.
CBP is working on mitigation guidelines for wood packaging material penalties "and has prioritized their completion," an agency spokesman said. CBP takes the threat of invasive pests seriously and the WPM enforcement is meant to prevent such pests from entering the U.S. in wood packaging, the spokesman said. "The policy change to issue penalties for each WPM violation has raised awareness of WPM regulations," he said. CBP issued guidance on WPM violations in November 2017 stating that it planned to increase the frequency of penalties for WPM violations (see 1711030034).
