CBP released its Sept. 12 Customs Bulletin (Vol. 52, No. 37). While it does not contain any rulings, it contains CBP general notices and Court of International Trade decisions. CBP also said it granted "Lever-Rule" protection to Kimberly-Clark for baby wipes made in England with the "HUGGIES" trademark intended for sale outside the U.S. The company asked CBP in February (see 1802130007) to stop importation of the products intended for sale in countries outside the U.S., known as gray market products.
Reusable shipping containers imported by Bosch after being used to export automobile equipment may be valued using a “fallback method” of depreciating the containers over a five-year period, CBP said in a recent ruling. No other means of valuation is available, in part because the containers are simply being returned and aren’t being sold in the U.S., so CBP deemed depreciation an acceptable method in line with other recent rulings on similar merchandise.

CBP made some small changes to its implementation instructions for the U.S-Korea Free Trade Agreement (KORUS). Among the changes from the previous version from 2012, CBP refers to KORUS instead of UKFTA and added a new line regarding verification of KORUS claims by CBP. Importers are required to provide information to CBP upon request and "although the producer may elect to provide this documentation directly to CBP to protect business sensitive information, the importer remains responsible for its presentation," the new line says. Now removed from the same section is a line that reads: "Subsequent to the initial contact with the importer, CBP may, at its discretion, communicate directly with the exporter or producer."
Port directors will make case-by-case determinations on whether to allow carriers to unlade cargo after being diverted from another U.S. port due to Hurricane Florence, CBP said in a CSMS message. There's a hurricane watch in effect for the Carolinas, Virginia and Maryland. For diverted vessels, "the owner or agent of the vessel shall immediately give notice of the diversion to the port that granted the permit or clearance, identifying the new destination of the vessel," CBP said. "In this instance, ports should allow for electronic/telephonic Reports of Diversion by the vessel’s owner/operator or agent. The originating port should log the date/time notifications are received and advise the owner or agent of the vessel to note on the CBP Form 3171, provided to the alternative port, its request for diversion and the specific situation for the diversion."

CBP provided some instructions for transmitting manual entry summaries. While manual entry summaries are not transmitted through the Automated Broker Interface, they are accepted into ACE, it said. The document and timeliness requirements are the same for non-ABI entry summaries as for other entry summaries. CBP will give the invoice, which serves as the release notification, to the non-ABI filer after a CBP review, it said. CBP will also allow lineless non-ABI entry summary input for "the following entry types: 01, 04, 05, 08, and 11 (consolidated) transactions only, 21, 22, 24, 25, and 31," CBP said. "U.S. Virgin Island ports only may use lineless Non-ABI Entry Summary input for the following entry types; excluding only Quota, AD/CVD, Reconciliation, Drawback and Vessel Repair: 01, 06, 08, 11, 21, 22, 23, 24, 25, 31, 51, and 52."
