CBP agriculture specialists will accept electronic submissions of all import documents, including veterinary health certificates, via the ACE Document Image System (DIS) for some products, CBP New York said in an informational pipeline dated March 23. The new policy, meant to address concerns related to the COVID-19 pandemic, will remain in effect through May 16, CBP New York said.

CBP created Harmonized System Update (HSU) 2003 on March 18, containing 8,453 Automated Broker Interface records and 1,413 Harmonized Tariff Schedule records, it said in a CSMS message. The update includes the increase to Section 301 tariffs on European Union aircraft and other changes related to the Boeing-Airbus dispute at the World Trade Organization (see 2002180040). The update also covers recent Section 301 tariff exclusions for medical goods on list 4A (see 2003060042 and 2003130010) and recently released Section 301 tariff exclusions for goods on the third list (see 2002190015).
The CBP National Commodity Specialist Division is still accepting binding ruling requests, but “paper binding ruling requests and requests that include or necessitate a sample may be delayed in processing and/or issuance,” CBP said in a CSMS message. Filers are encouraged to use the eRulings website for ruling requests and to include detailed “photographs or short videos of the product to be submitted in lieu of samples,” it said. “However, we recognize that certain commodities require a sample in order for a determination to be made. In such cases, delays may occur. The National Import Specialist assigned to work on your ruling will reach out to you to discuss your options and whether a determination can be made without a sample.”

CBP is not currently planning to allow for delayed deadlines for protest filings or postpone ACE development due to the COVID-19 outbreak, CBP officials said during a March 19 conference call. It will give more time to comply with bond insufficiency issues, it said in a March 19 CSMS message." Due to the operational impacts that COVID-19 is having on the Trade community, CBP is granting a 10-day extension for the termination and replacement of bonds found to be insufficient and for which notices were issued with a due date of March 21, 2020," it said. "The insufficient bond should be scheduled for termination by March 31, 2020, with a termination date no later than April 15, 2020. CBP is operating under normal procedures and is able to complete processing and reviews timely. As a result, the April bond sufficiency reviews and notices will not be postponed at this time. CBP will continue to monitor the situation daily and make additional extensions if deemed necessary."
