The recent CBP notice on the marking requirements for goods produced in Hong Kong (see 2008100027) applies only to the marking provisions involved, a CBP spokesperson said by email on Aug. 11. Asked if CBP would address whether the change to Hong Kong's special trade status affects tariff treatment, the spokesperson said: “As outlined in the Federal Register Notice, this action pertains only to the markings of goods imported from Hong Kong.” The spokesperson also said “'Hong Kong, China' is not an acceptable marking” under the new requirements. “With respect to imported goods produced in Hong Kong, such goods may no longer be marked to indicate 'Hong Kong' as their origin, but must be marked to indicate 'China,'” he said.

The Customs Rulings Online Search System (CROSS) was updated Aug. 11 The following headquarters rulings were modified recently, according to CBP:
CBP “personnel from the Ports of Entry and Centers of Excellence and Expertise (Centers) are directed to neither issue marking notices, nor take further enforcement actions on goods produced in Hong Kong” until Sept. 25, the agency said in a CSMS message. CBP is allowing for a transition period for the new marking requirements on goods produced in Hong Kong, which will have to be marked as from China starting Sept. 25 (see 2008100027). “Centers should take measures to inform accounts of these new marking rules for Hong Kong set forth in the” July 14 presidential Executive Order on Hong Kong Normalization, it said. CBP still hasn't specifically addressed whether Hong Kong goods will be subject to the Section 301 tariffs on goods from China or other trade remedies.

CBP is seeking comments by Oct. 6 on existing information collection requests for entry summaries, foreign-trade zone annual reconciliation certification and record keeping requirements, exportation of articles under special bond, cost submissions and entry of articles for exhibition, it said in notices published in the Aug. 7 Federal Register. CBP proposes to extend the expiration date of these information collections with no change to the burden hours or the information collected.
