CBP released its Aug. 26 Customs Bulletin (Vol. 54, No. 33). While it does not contain any customs rulings, it contains CBP general notices and Court of International Trade decisions. CBP also issued a notice on its grant of a “Lever-Rule” protection to Monster Energy 250ML bottled beverages intended for sale outside the U.S. CBP grants such protection when it finds the parts are physically and materially different from the products intended for sale in the U.S., it said.
CBP will “deploy the modernized e214 Online Admission Process” for Foreign-Trade Zones on Sept. 26, the agency said in an Aug. 26 notice. The update eliminates or replaces “older, inefficient processes and reduces the effort needed for filers to remedy FTZ inventory or reporting discrepancies.” Among the changes are an increase in the number of digits used in ACE Zone IDs, from seven digits up to nine, CBP said. “While the expanded Zone ID functionality will deploy on September 26, 2020, nine-digit Zone IDs have not yet been allocated and should not be transmitted to CBP until 120 days after publication of updated regulations in the Federal Register,” the agency said. Also, the update will allow Electronic Data Interchange filers to cancel a permit to transfer and to request the ability to fix reporting discrepancies after admission, CBP said.
CBP is seeking comments by Oct. 26 on an existing information collection request on customs broker triennial reports, applications for broker permits and licensing exams, it said in a notice Aug. 27. CBP proposes to extend the expiration date of this information collection with no change to the burden hours or the information collected.

Recent Treasury Department sanctions and Commerce Department entity list additions imposed for the use of forced labor in China's Xinjiang Province could indicate coming action by CBP to restrict imports from the region, Arent Fox lawyers posted Aug. 25. Among those sanctioned by Treasury was the “Xinjiang Production and Construction Corps (XPCC), which reportedly produces more than 7 percent of the world’s cotton,” the firm said. “[D]ue to the tie-in, the Administration has drawn between the entity and forced labor in the Xinjiang Province, there is a risk that garments made from cotton produced by XPCC could be subject” to CBP withhold release orders (WROs). Similarly, Commerce added multiple Chinese textile and apparel companies to the entity list, which means “there is a risk that garments made from Entity List entities who are listed due to forced labor allegations could be subject to a CBP WRO.” CBP didn't comment.
