CBP published the quarterly Internal Revenue Service interest rates used to calculate interest on overdue accounts (underpayments) and refunds (overpayments) of customs duties. For the quarter that began Oct. 1 and ends Dec. 31, the interest rates for overpayments remains 2% for corporations and 3% for non-corporations, and the interest rate for underpayments will be 3% for both corporations and non-corporations. These interest rates are subject to change for the Jan. 1-March 31 quarter, CBP said.
The Department of Homeland Security general counsel approved an advance notice of proposed rulemaking on customs broker continuing education requirements (see 2009140033) Oct. 6, said John Leonard, CBP executive director-trade policy and programs. Leonard mentioned the progress during the Oct. 7 Commercial Customs Operations Advisory Committee (COAC) meeting. “We're going to work to get it out with the Federal Register as soon as possible, so you'll be seeing that soon,” he said. “It's an extremely well-written notice and I think it's really going to get us to the next level in terms of that program.”

There could be an “announcement” soon related to the Department of Homeland Security report that examined possible ways to stop imports of counterfeit goods (see 2001240043), said Michael Ding, Department of Homeland Security acting deputy assistant secretary for strategy, policy and plans. Ding highlighted the “hard work together here implementing the recommendations from the report,” during the Oct. 7 Commercial Customs Operations Advisory Committee (COAC) meeting. “Along those lines there might even be an announcement, maybe in a day or so,” he said. Ding said he couldn't “really talk about it just yet, but stay tuned.”
