At the height of the Section 301 exclusions, 10% of imports covered by the China tariffs were excluded, according to a new Government Accountability Office report, though that fell from 10% to 7% across 2020, as exclusions expired and were not extended. The agreement the U.S. Treasury reached last week with the State Bank of Vietnam to address U.S. allegations that Hanoi was devaluing the dong against the dollar to the detriment of American trade interests (see 2107190035) was a "satisfactory resolution” of the Section 301 investigation launched in October into Vietnamese currency manipulation, said an Office of the U.S. Trade Representative notice Friday. USTR “has determined that no action under the Section 301 investigation is warranted at this time,” said the agency.

The National Customs Brokers & Forwarders Association of America is backing CBP's proposed use of Part 102 marking rules to determine the country of origin for non-preferential claims under USMCA (see 2107010045), the trade group said in a July 27 email. CBP proposes to use NAFTA's Part 102 tariff shift marking rules for determining country of origin for non-preferential USMCA claims and government procurement. Some have wondered whether the proposal will prove to be controversial (see 2107070011 and 2107080040).
