The U.S. expanded export controls on Russia to cover a broader range of “commercial and industrial operations,” including wood products and construction machinery, the Commerce Department said. The new controls make more items on the Export Administration Regulations subject to “stringent” licensing restrictions for export to Russia, the Bureau of Industry and Security said in a final rule that includes the specific Schedule B numbers and Harmonized Tariff Schedule codes of the newly restricted items. Commerce said the items previously didn’t require a license for “most exports” to Russia.
PHILADELPHIA -- The Bureau of Industry and Security has no immediate plans to remove the virus that caused the outbreak of the coronavirus disease, SARS-CoV-2, from its export control classification of EAR99 (see 2002250069), a government official said. Removing the virus from EAR99 -- a classification for products that generally don't require export licenses under the Export Administration Regulations -- could subject exports of the virus to restrictions that may hinder vital information sharing or vaccine delivery, the official said.
Anthony Rapa, a former partner at Kirkland & Ellis, joined Blank Rome as a partner in its National Security practice, the firm announced. Blank Rome said Rapa will work on "sanctions and export control-related matters in cross-border transactions, mergers and acquisitions, government investigations, and regulatory matters." The U.S. is looking into whether Chinese semiconductor manufacturer Yangtze Memory Technologies Co. violated U.S. export controls by supplying chips to Huawei, the Financial Times reported April 27. The report said the Bureau of Industry and Security received a “credible” report by TechInsights, a semiconductor analysis firm, that Huawei is using YMTC memory chips in a new smartphone. The chips were reportedly made in February 2021, several months after the U.S. applied its foreign direct product rule to Huawei, which restricts its ability to import foreign-produced goods made with certain levels of U.S.-origin content or technology (see 2005150058).
The Bureau of Industry and Security on April 21 suspended the export privileges of another Russian airline for violating U.S. export controls against Russia. The agency issued a 180-day temporary denial order for Moscow-based cargo aircraft carrier Aviastar, which will limit the airline’s ability to deliver goods to Russia’s military, BIS said. Aviastar will be barred from participating in transactions with items subject to the Export Administration Regulations.

The Commerce Department is investigating U.S. software company Synopsys for possibly violating U.S. export controls against China, Bloomberg reported April 13. Commerce is looking into whether Synopsys, the world’s leading supplier of semiconductor design software, worked with Chinese affiliates to provide chip designs and software to Huawei Technologies’ HiSilicon unit for manufacture at Semiconductor Manufacturing International Corporation, the report said. Both companies are subject to Entity List licensing restrictions.

The agency also added two additional planes owned by Utair and one aircraft owned by Aeroflot. BIS said it will impose penalties and/or jail time or revoke export privileges for any company or person who violates the Export Administration Regulations by providing “any form of service” to the listed aircraft without a required BIS license.
