CIT Enjoins Liquidation of Heat Sinks, Limits Scope of Requested Injunction
The Court of International Trade on Dec. 8 issued a statutory injunction against the liquidation of any unliquidated entries of importer IPG Photonics' heat sink models, while the importer challenges the Commerce Department's antidumping duty and countervailing duty orders scope ruling on IPG's products (IPG Photonics v. United States, CIT # 25-00212).

Judge Gary Katzmann agreed to the injunction, though he limited its scope after the U.S. said IPG requested overly broad relief. Specifically, the judge limited the injunction to "unliquidated entries" only that were entered or withdrawn for consumption after May 26, 2011.
IPG brought the case to challenge Commerce's findings that the importer's heat sink models don't fit under the explicit exclusion under the AD/CVD orders on aluminum extrusions from China for "finished heat sinks" (see 2510270019).
