Bill Would Bar Charging Fees for Export Licenses

Reps. Sydney Kamlager-Dove, D-Calif., ranking member of the House Foreign Affairs Subcommittee on South and Central Asia, which oversees the Bureau of Industry and Security, and Raja Krishnamoorthi, D-Ill., ranking member of the House Select Committee on China, introduced a bill Nov. 7 that would prohibit the executive branch from charging fees for export licenses.

The BIS License Fee Prohibition Act aims to prevent the Trump administration from allowing Nvidia and AMD to sell certain controlled computing chips to China in exchange for a portion of their sales revenue (see 2508150034 and 2508110044).

Kamlager-Dove and Krishnamoorthi said the administration’s plan violates the Constitution, which prohibits placing taxes or duties on exports, and the Export Control Reform Act, which bars charging fees for export licenses. They also said export licensing decisions should be guided by national security concerns and not be used to extract revenue.

Their bill was referred to the Foreign Affairs Committee.
