CPPA Expects OAL Decision on Deletion Rules by Nov. 7 Board Meeting

The California Privacy Protection Agency could have a decision from the state's Office of Administrative Law (OAL) on Delete Act regulations just in time for the CPPA board's Nov. 7 meeting.

CPPA staff plans to update the CPPA Board on the Delete Request and Opt-Out Platform (DROP) during the session, according to an agenda released Tuesday. Other items include updates on intergovernmental affairs, legislation and agency proposals and regulations proposals and priorities.

The agenda says that the CPPA Board may also possibly adopt or modify the text of proposed rules for the upcoming DROP platform, which will help consumers make deletion requests to registered data brokers. However, board members already voted 5-0 in September to adopt regulations for the accessible delete mechanism (see 2509260039). Those rules are now pending final approval at the California OAL, though the office could decide to request further changes.

“The DROP regulations are with OAL, and we have that agenda item in case we need to address anything with the Board based on feedback from OAL,” a CPPA spokesperson clarified in an email to Privacy Daily. The privacy agency expects OAL's decision by Nov. 7, the same day as the CPPA meeting, added the spokesperson.

The CPPA launched a webpage previewing DROP for consumers on Friday (see 2510240053). It plans to release the accessible data deletion mechanism Jan. 1. The agency also plans to demonstrate DROP at the IAPP conference later this week in San Diego.
