CIT Stays One Rail Coupler Case as Another Gathers Steam
Court of International Trade Judge Gary Katzmann agreed March 3 to stay a case brought by rail coupler importer Amsted Rail Co. until a similar case concludes (Amsted Rail Co. v. United States, CIT # 23-00268).

The litigation to be stayed involved, among other things, Amsted’s claim that the International Trade Commission hadn’t reconciled “contradictory conclusions” it reached on the same evidence when the commission started a second investigation into Amsted’s products only two months after reaching a negative injury determination in a previous one (see 2409090028).
The case will be stayed until a similar case, this one brought by importers Strato and Wabtec, ends (see 2502280058). The two importers, whose products also were deemed injurious by the second investigation, have made similar arguments to Amsted. Recently, they also alleged that the domestic rail coupler industry committed fraud that impacts the ITC’s conclusion (see 2502060065), which petitioner Coalition of Freight Rail Coupler Producers denies (see 2502280058).
