Air Fryer Importer Says Products Not Just Regular Ovens

A company that imports air fryers brought a complaint to the Court of International Trade on June 5, arguing that its fryer are not “cooking stoves, ranges or ovens” but rather fall under the relevant “other” category (Sensio Inc. v. U.S., CIT # 23-00152).

Importer Sensio said that some of its 2021 entries were liquidated by CBP under Harmonized Tariff Schedule subheading 8516.60.40 for ovens and stoves. The heading carries a 25% Section 301 tariff.

The goods instead should have been liquidated under subheading 8516.79.00 for “other” electric heating appliances.

“Sensio’s air fryers are considerably more than ovens,” it said.
