Shrimp: Amended Prelim CVD Cash Deposit Rates for Ecuador

Suspension of liquidation and countervailing duty cash deposit requirements won't take effect until further notice for Sociedad Nacional de Galapagos C.A., Naturisa S.A., Holding Sola & Sola Solacciones S.A., and Empacadora Champmar S.A., the Commerce Department said in a notice released April 24 amending its preliminary determination in its CVD investigation on frozen warmwater shrimp from Ecuador (C-331-806). The agency also is amending the all-others rate for Ecuador it set in the April 1 preliminary determination (see 2403290027).

The agency said it mistakenly didn't find that the 1.69% CVD rate assigned to Sociedad Nacional de Galapagos and its affiliates was below the de minimis threshold. Because the rate is de minimis, Sociedad Nacional de Galapagos isn't subject to CVD until further notice, and if Commerce continues to give the company and its affiliates a de minimis rate in its final determination, any merchandise both produced and exported by the companies will be exempt from any CVD order issued in connection with this investigation. Suspension of liquidation may still apply for AD purposes should Commerce find dumping for these companies in its upcoming preliminary AD determinations.

Commerce's finding that Sociedad Nacional de Galapagos qualifies for a zero rate also results in a revision to the all-others rate for Ecuadorian exporters, which is now solely based on the rate assigned to Industrial Pesquera Santa Priscila. Amended rates, which are applicable as of April 25, are as follows:
