Feb. 21 CBP Bulletin Proposes to Revoke Rulings on Glass Containers With Lids

In the Feb. 21 Customs Bulletin (Vol. 57, No. 7), CBP published a proposal to revoke and modify ruling letters concerning glass containers with lids.

Comments on Proposal Due March 22

CBP said consideration will be given to any written comments received by March 22 before taking these actions. In addition, any party that has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations after the effective date of the final decision in this notice.)

Proposal

CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP also is proposing to revoke any treatment it has previously accorded to substantially identical transactions.

Glass Containers Imported With lids

Proposed: 7010.90.50, free, “Carboys, bottles, flasks, jars, pots, vials, ampoules and other containers, of glass, of a kind used for the conveyance or packing of goods; preserving jars of glass; stoppers, lids and other closures, of glass: Other: Other containers (with or without their closures).”
Reason: As the articles at issue in the above-referenced rulings do not belong to the class or kind of articles used for in-home decoration, storage or consumption, and they are used for the conveyance of poured candles and are marketed and sold as filled candles, they belong to the class or kind of goods principally used for the conveyance of goods
