The Commerce Department has released the final results of the antidumping duty administrative review on carbon and alloy steel cut-to-length plate from South Korea (A-580-887). Export Compliance Daily combines U.S. export control news, foreign border import regulation and policy developments into a single daily information service that reliably informs its trade professional readers about important current issues affecting their operations.
Commerce said it made several changes to the calculation used in the preliminary results for the lone mandatory respondent POSCO (as a single entity, including affiliates), still resulting in a zero percent dumping margin.
New Cash Deposit Rates Take Effect Dec. 14
For entries on or after Dec. 14, the date these final results are to be published in the Federal Register, Commerce is setting a new AD duty cash deposit rate as follows:
Exporter | AD Rate |
---|---|
POSCO and affiliates POSCO International Corporation, POSCO MS, and certain distributors and service centers (i.e., Taechang Steel Co., Ltd. and Winsteel Co., Ltd.) | zero |
For exporters of subject merchandise that were not under review (i.e., all except POSCO and affiliates), cash deposit rates remain at the level set in the most recent review of each respective company. If the exporter has never been assigned its own AD rate but the manufacturer has, the rate assigned to the manufacturer applies. For merchandise manufactured and exported by companies that have never been assigned a cash deposit rate by Commerce, the "all others" rate of 7.1% applies.
Assessment Rates for Entries May 2021 - April 2022
Commerce is using the rates it calculated in these final results to calculate assessments of AD duties on importers of subject merchandise for entries between May 1, 2021, and April 30, 2022. Commerce will instruct CBP to liquidate without regard to AD entries from POSCO and its affiliates during the review period.
(The review period is 05/01/21 - 04/30/22. See Commerce's notice for more information, including the scope of the order, detailed cash deposit and assessment instructions, etc. See 2306200041 for a summary of the preliminary results of this administrative review.)
