Bipartisan Bill Would Allow Reliquidation After Deadline for Retroactive Section 232 Exclusions
A bill introduced by Sens. Sherrod Brown, D-Ohio, J.D. Vance, R-Ohio, and Rep. Brad Wenstrup, R-Ohio, would allow importers who paid Section 232 tariffs on steel or aluminum products that were later granted exclusions to get that money back, even if the deadline for liquidation or reliquidation has passed.

This would cover exclusions granted in 2020 and 2021. The importers would have 180 days after the bill becomes law to request the refund, and as long as the application has sufficient information to allow CBP to identify and reconstruct the entry, and verify it's covered by the exclusion, CBP would issue the refund (without interest).
Brown's office said: "Ohio companies should not be denied refunds they’re owed because of bureaucratic delays. This legislation will provide those companies, including Lincoln Electric in Cleveland, Ohio, the opportunity to file a refund request and receive any funds they are owed."
