Security Act of 2002 gave DHS authority over the ports, but despite this transfer of power, the customs regulations still say the authority for these ports lies with the Department of the Treasury. CBP is amending the corresponding regulations to say that DHS has this authority over the ports and that DHS has the power to "establish, rearrange or consolidate, and discontinue" Customs stations as "operational needs may require."
