Gray alleged in a Sept. 15 complaint that KSDK stole its First Alert Weather mark with its own Weather First logo (see 2309180002), but KSDK answered Nov. 2 with 15 affirmative defenses denying the allegations, including its assertion that “the doctrine of fair use” bars some or all of Gray’s claims (see 2311030050). A joint proposed scheduling plan is due Dec. 12, said Collins’ order. Counsel at the scheduling conference itself “will be expected to discuss in detail” all Rule 16 matters, plus the issues set forth in their joint proposed scheduling plan, said her order: “A firm and realistic trial setting will be established at or shortly after the conference.”
