Commerce is also rescinding this review with respect to 66 companies for which all review requests were withdrawn. See Appendix II of the notice for a complete list of the companies.
Further, Commerce preliminarly determined that four companies -- Bien Dong Seafood Co., Ltd.; Vinh Hoan Corp.; Seavina Joint Stock Company; and BIM Foods Joint Stock Company -- had no shipments of subject merchandise during the period of review. If Commerce finds the same in its final results, the cash deposit rates currently in effect for these four companies will not change, and any entries during the period of review reported under their case numbers will be assessed duties at the 25.76% Vietnam-wide rate.
There are 121 companies remaining in the review, with 117 of the companies that had exports of subject merchandise assigned to the Vietnam-wide entity. See Appendix III of the notice for a complete list.
In its final results, Commerce will set assessments on importers of AD for subject merchandise entered Feb. 1, 2022, through Jan. 31, 2023. If these preliminary results are adopted unchanged, Commerce will assess duties at 25.76% for importers from 117 Vietnam-wide companies.
Only the 121 exporters of subject merchandise for which an administrative review was requested are covered by this review. Cash deposit rates for all other exporters will not change. Commerce has ordered liquidation "as entered" for entries during the period of review from all exporters for which a review was not requested or the request was withdrawn, in messages to CBP (ADCVDWeb Message # 3137421).
(The period of review is 02/01/221 - 01/31/23. See the notice for additional information, including the scope of the order, potential cash deposit and assessment instructions, etc.)
