Export Compliance Daily combines U.S. export control news, foreign border import regulation and policy developments into a single daily information service that reliably informs its trade professional readers about important current issues affecting their operations.
Commerce also determined that one mandatory respondent didn't make sales of subject merchandise at below normal value during the review period.
New Cash Deposit Rates Take Effect Nov. 2
For entries on or after Nov. 2, the date these final results are set to be published in the Federal Register, Commerce is setting new AD duty cash deposit rates for some companies, as follows:
| Exporter | AD Rate |
|---|---|
| Kanika Exports | zero |
| R K Fasteners (India) | 2.37% |
| Review Average Rate (applicable to 112 companies) | 2.37% |
Average Rate. Commerce didn't individually investigate 112 companies subject to this review and instead assigned them the average of the rates assigned to the individually investigated companies, Kanika Exports and R K Fasteners (India). See Appendix II in Commerce's notice for a full list of these 112 companies.
For exporters of subject merchandise that were not under review (i.e., all except the 114 companies listed), cash deposit rates remain at the level set in the most recent review of each respective company. If the exporter has never been assigned its own AD rate, but the manufacturer has, the rate assigned to the manufacturer applies. For merchandise manufactured and exported by companies that have never been assigned a cash deposit rate by Commerce, the all-others rate applies, i.e., zero percent.
Assessment Rates for Entries April 2021 - March 2022
Commerce is using the rates it calculated in these final results to calculate assessments of AD duties on importers of subject merchandise for entries between April 1, 2021, and March 31, 2022. Commerce will liquidate entries from Kanika Exports at importer-specific AD rates, and entries from R K Fasteners (India) without regard to AD. Commerce will assess AD at the rates listed above for the other companies subject to this review.
(The review period is 04/01/21 - 03/31/22. See Commerce's notice for more information, including the scope of the order, detailed cash deposit and assessment instructions, etc. See 2305030058 for summary of the preliminary results of this administrative review.)
