Pressure Washers: Details of AD Duty Order on Vietnam
The Commerce Department issued an antidumping duty order on gas powered pressure washers from Vietnam (A-552-008). The order sets permanent antidumping duties, which will remain in place unless revoked by Commerce in a sunset or changed circumstances review. Commerce will now begin conducting annual administrative reviews, if requested, to determine final assessments of AD on importers and make changes to cash deposit rates.

The order details a four-day “gap period” of no AD liability for subject merchandise entered Oct. 13-17, 2023. Commerce may only suspend liquidation for four months after its preliminary AD determination, issued June 15, 2023, without the ITC having found injury (that period is extendable to six months in AD cases, but no request for extension was filed in this case). Commerce will order CBP to liquidate, without regard to duties, any entries during this gap period.
Commerce also has issued preliminary determinations in concurrent, ongoing AD investigations on gas powered pressure washers from China (see 2308140025 and 2306020016). Final determinations in those investigations are currently due Dec. 18.
Refunds of Retroactive AD Cash Deposits
Commerce reversed its finding of critical circumstances for Vietnamese exporters. As a result, Commerce will refund all AD cash deposits collected on entries of gas powered pressure washers from Vietnam prior to June 15, 2023.
AD Suspension of Liquidation Instructions
Suspension of liquidation resumes for all entries of subject merchandise from Vietnam entered on or after Oct. 18, the date that the final ITC affirmative injury determination was published.
AD Cash Deposit Instructions
An AD cash deposit requirement is also back in effect for subject merchandise entered on or after Oct. 18, equal to the rates listed below:

Commerce determined that because no companies demonstrated that they are independent from Vietnamese government control and eligible for a rate separate from the Vietnam-wide entity, all exporters of Vietnamese gas powered pressure washers are part of the Vietnam-wide entity.
