BIS Sets Effective Dates, Comment Periods for New Chip Rules

The Bureau of Industry and Security on Oct. 18 placed its two new China chip export control rules on public inspection for publication in the Federal Register, which set the effective dates for both rules (see 2310170055).

The BIS interim final rule placing restrictions on additional semiconductor manufacturing items, along with other measures, takes effect Nov. 17, with public comments due by Dec. 18. Amendatory instruction 5, which removes paragraph (d) of supplement number 1 to part 736 -- the portion of the Oct. 7, 2022, rule that describes the temporary general license -- takes effect Jan. 1, 2026.

The other interim final rule, expanding export controls on additional advanced chips along with other measures, also takes effect Nov. 17, with comments due Dec. 18. Amendatory instruction 11, which describes the rule’s new temporary general license, is effective from Nov. 17, 2023, through Jan. 1, 2026.
