Commerce Sets New AD/CVD Requirements on Steel Staples From Thailand, Vietnam
The Commerce Department is suspending liquidation and setting new antidumping and countervailing duty cash deposits on all imports of collated steel staples from Thailand and Vietnam made from certain Chinese-origin inputs, after preliminarily finding that the imports are circumventing AD/CV duties on collated steel staples from China (A-570-112/C-570-113), the agency said.

Suspension of liquidation and cash deposit requirements take effect country-wide for all collated steel staples from Thailand and Vietnam entered on or after Dec. 21, 2022, the date that Commerce published notice of the initiation of the anti-circumvention inquiry (see 2212200031).
The agency’s preliminary determination, published Aug. 24, found circumvention by imports of collated steel staples from Thailand made using Chinese-origin steel wire and wire band, as well as imports of collated steel staples from Vietnam made using Chinese-origin wire band.
Commerce is setting a certification process for collated steel staples from Thailand and Vietnam that do not use those Chinese inputs and are therefore exempt from the circumvention finding and any suspension of liquidation or cash deposit requirements. Two Vietnamese companies, Meihotech and Weifang Wenhe, did not cooperate in the proceeding and will be ineligible for the certification process and the duty exemption, Commerce said.
For any unliquidated entries on or after Dec. 21, 2022, that were not made using Chinese wire band (for Vietnam and Thailand) or steel wire (for Thailand), importers and exporters must file certifications by 45 days after the preliminary determinations are published in the Federal Register, i.e., Oct. 9.
For any unliquidated entries on or after Dec. 21, 2022, that were declared as non-AD/CVD Type 01 entries, importers should file a post-summary correction with CBP to change the entry type to an AD/CVD type, such as Type 03. Importers should report the case numbers A-549-112/C-549-113 for Thailand, and A-552-112/C-552-113 for Vietnam.
