Commerce Begins Anti-Circumvention Inquiry on South Korean Aluminum Sheet

The Commerce Department will consider whether a South Korean company that produces common alloy aluminum sheet using flat-rolled aluminum from two Chinese companies is circumventing antidumping and countervailing duties on common alloy aluminum sheet from China (A-570-073/C-570-074), the agency said in a notice beginning an anti-circumvention inquiry.

Commerce will determine whether to extend the duties on Chinese common alloy aluminum sheet to aluminum sheet produced in South Korea by Gwangyang Aluminum, assembled or completed using flat rolled aluminum having a thickness greater than 6.3 mm produced by Henan Mingtai or Zhengzhou Mingtai in China, and exported to the U.S. The Chinese aluminum inputs are not subject to the common alloy aluminum sheet duties, Commerce said.

If imposed, AD/CVD would apply only to merchandise produced by Gwangyang Aluminum, and not all South Korean exports.

Commerce’s preliminary determination in this anti-circumvention inquiry is due in 150 days. If Commerce finds circumvention in its preliminary determination, it may suspend liquidation and require cash deposits retroactive at least to the July 13 publication date of this initiation notice.
