China Pressure Washers: Prelim CV Cash Deposit Rates Take Effect, Retroactive for Some
The Commerce Department is setting new countervailing duty cash deposit requirements for imports of gas powered pressure washers from China (C-570-149), after finding illegal subsidization of Chinese producers in the preliminary determination of its CV duty investigation. Suspension of liquidation and cash deposit requirements generally take effect June 5, but Commerce is making the suspension of liquidation and CV duty cash deposits retroactive to approximately March 7 for some Chinese companies.

Commerce is also considering the imposition of antidumping duties on gas powered pressure washers from China, as well as the same product from Vietnam. The agency's preliminary AD duty determination on China is currently due July 28 (see 2301240018).
Commerce Finds Critical Circumstances for Some; Cash Deposits Retroactive 90 Days
Commerce made a finding that Jiangsu Jianghuai Engine Co., Ltd. (JD Power), Chongqing Dajiang Power Equipment Co., Ltd. (CDPE) and 15 other companies listed below that received a 206.57% rate because they didn't answer a Commerce questionnaire increased their exports to the U.S. in the run-up to the preliminary determination, in an attempt to get in as much product as possible before the imposition of CV duties. This "critical circumstances" finding by the agency means Commerce will retroactively suspend liquidation for these companies back to 90 days before the preliminary determination, i.e., on or about March 7.
CV Suspension of Liquidation and Cash Deposit Requirements
Commerce says it will instruct CBP to suspend liquidation for all entries of subject merchandise that are entered, or withdrawn from warehouse, for consumption on or after June 5, except for subject merchandise exported by JD Power, CDPE and 15 other companies listed below, for which suspension of liquidation will take effect for entries on or after approximately March 7. Preliminary CV cash deposit rates will be required as follows:
