Commerce Begins Anti-Circ Inquiry on Smaller Capacity Nonrefillable Cylinders From China

The Commerce Department is beginning an anti-circumvention inquiry into allegations that imports of nonrefillable steel cylinders with a water capacity between 100 and 299 cubic inches are circumventing the antidumping and countervailing duty orders on nonrefillable steel cylinders from China, the agency said in a notice released May 31.

The inquiry will cover all nonrefillable cylinders with a water capacity between 100 and 299 cubic inches that are produced in China and exported to the U.S., Commerce said. Currently, the scope of the AD/CVD orders only covers nonrefillable cylinders with a capacity of 300 cubic inches to 1,526 cubic inches.

Worthington Industries, which requested the inquiry, alleges the lower-capacity nonrefillable cylinders are merchandise developed after the orders and altered in minor respects to circumvent the duties.

Commerce’s preliminary determination in this anti-circumvention inquiry is due in 150 days. If Commerce finds circumvention in its preliminary determination, it may suspend liquidation and require cash deposits retroactive at least to the June 1 scheduled publication date of this initiation notice.
