Census 'Reverted' Display of Proposed USML Filing Requirement
The Census Bureau is nixing plans to update its Automated Export System early with a new proposed export filing requirement for certain U.S. Munitions List exports, CBP said in a May 10 CSMS message. Census last week said it planned to update the AESDirect web application May 9 with the new data element (see 2305040024) even though it had just proposed the electronic export filing requirement one day earlier and was still soliciting public comments on the change, which are due July 3 (see 2305020007).

Census, CBP and the State Department’s Directorate of Defense Trade Controls "reverted" the "requirement of the Category XXI Determination Number data element when the USML Category XXI is entered," the message said.
A Census spokesperson said the data element was only “intended to alert filers” of the potential filing requirement, which, if implemented in a final rule, would require exporters to report in AES when shipping items classified under USML Category XXI. “CBP, DDTC and the Census Bureau believe we can more optimally achieve this in another way and we will be issuing a new AES Broadcast notice in the next few days to clarify this communication,” the spokesperson said in a May 10 email.
